Terms of Service

1. Agreement

By downloading, installing, or using MiVia ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. MiVia is operated by Del Puerto Pty Ltd ("we", "our", "us").

2. Description of Service

MiVia is an AI-powered personal assistant for iPhone that helps you manage your calendar, reminders, contacts, projects, and email. The App uses artificial intelligence (powered by Anthropic's Claude) to understand your requests and provide helpful responses.

MiVia integrates with your device's native data (calendar, contacts, reminders, health, email) to provide context-aware assistance while maintaining your privacy through on-device data processing and sanitization.

3. AI-Generated Content

MiVia's responses are generated by artificial intelligence and are provided for informational and organizational purposes. You acknowledge that:

• AI-generated responses may not always be accurate, complete, or up-to-date
• MiVia is not a substitute for professional medical, legal, financial, or other expert advice
• You are responsible for verifying important information independently
• Actions taken by MiVia (creating events, reminders, etc.) are performed at your direction and should be reviewed by you

4. Subscriptions & Billing

• Free tier: Limited to 10 AI messages per day and 1 project
• Pro subscription: Unlimited AI messages and projects, billed monthly ($19.95/month) or annually ($179.95/year) through the Apple App Store
• Free trial: New subscribers may be eligible for a 3-day free trial. The trial automatically converts to a paid subscription unless cancelled at least 24 hours before the trial period ends
• Billing: All payments are processed by Apple. Your Apple ID account will be charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• Managing subscriptions: You can manage or cancel your subscription at any time through your Apple ID settings (Settings > [Your Name] > Subscriptions)
• Refunds: Refund requests must be made through Apple's App Store

5. Acceptable Use

You agree not to use MiVia to:

• Generate harmful, illegal, abusive, or harassing content
• Attempt to reverse-engineer, decompile, or exploit the service or its underlying AI
• Circumvent usage limits or subscription requirements
• Impersonate others or misrepresent your identity
• Violate any applicable laws or regulations
• Interfere with or disrupt the service for other users

We reserve the right to suspend or terminate access for users who violate these terms.

6. Data & Privacy

Your use of MiVia is governed by our Privacy Policy, which describes how we handle your data. By using MiVia, you acknowledge that:

• Sanitized versions of your messages are sent to Anthropic's Claude AI for response generation
• Device data (calendar, contacts, health, email) is processed on your device and is never stored on our servers in raw form
• You are responsible for managing your device permissions and can revoke access at any time

7. Intellectual Property

MiVia and its original content, features, and functionality are owned by Del Puerto Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our written permission.

8. Disclaimer of Warranties

MiVia is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• AI-generated responses will be accurate, reliable, or suitable for any particular purpose
• The App will be compatible with all devices or operating system versions

The App depends on network connectivity for AI-powered responses. Offline functionality is limited to viewing previously stored data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Del Puerto Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use MiVia.

Our total liability for any claims arising from or related to the service shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Del Puerto Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of MiVia or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue MiVia (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through an in-app notification. Your continued use of MiVia after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
